Who Keeps the Car in a Divorce? 8 Things the Court Weighs
Nothing in the law says the car goes to whoever drives it, or whoever paid for it. In England and Wales the court looks at "all the circumstances of the case" and, under section 25 of the Matrimonial Causes Act 1973, at eight listed matters. Cars are not named among them. What the car is worth, and what each person needs it for, is what gets weighed.
Most couples agree who keeps which car without a court. Where they cannot, the same section 25 list applies to the whole settlement, and the car is one item in it. This guide sets out what the Act actually says, how a car fits into each matter, and why the value you put on it matters before anyone argues about who drives it home.

Does the law say who keeps the car?
No. Section 24(1)(a) of the Act lets the court order that one person transfer property to the other, and the car is property like any other. Section 25(1) tells the court to have regard to "all the circumstances of the case", with first consideration given to the welfare of any child of the family under 18. The section does not say that a car follows the driver, the owner on the V5C or the person who made the payments. Source: Matrimonial Causes Act 1973, section 25, read on 2 November 2026. It applies to England and Wales only.
What are the 8 matters the court weighs?
Section 25(2) says the court "shall in particular have regard to" these:
- the income, earning capacity, property and other financial resources of each person, now and in the foreseeable future;
- their financial needs, obligations and responsibilities, now and in the foreseeable future;
- the standard of living the family enjoyed before the breakdown of the marriage;
- the age of each person and how long the marriage lasted;
- any physical or mental disability of either;
- the contributions each has made or is likely to make to the welfare of the family, including looking after the home or caring for the family;
- conduct, if it would be inequitable to disregard it;
- in a divorce, the value of any benefit that either person will lose the chance of acquiring because of the divorce.
A car is argued under the first two. It is a resource, with a value, and it can also be a need: a car used for work or for the school run is the kind of thing "financial needs, obligations and responsibilities" covers. The Act does not say so in terms, and how much weight a need carries in your case is for your solicitor and, if it comes to it, the court.

Where does the car go on Form E?
Each person completes Form E. Section 2.8 lists personal belongings individually worth more than £500, and says to include "Cars (gross value)", giving the "Total current value of your interest". Any finance on the car goes in section 2.9, headed "Details of any liabilities you have", which lists hire purchase agreements. The form was read on 2 November 2026. So the value on the form is the gross figure, and what is owed on the car is shown separately.
If the car is in one name and used by both, the form asks for your interest, so the name on the V5C is not the end of the question. Whose money paid for it, and whether it was bought before or during the marriage, are matters to raise with your solicitor.
How does a value help decide who keeps it?
If one of you keeps the car, the value is what sets the price of that choice: the other person can receive something of matching value elsewhere in the settlement. Without a figure, each side argues from a number it likes. A figure with comparable cars behind it gives both sides one to start from. We explain how that works in how a car's value is offset in a divorce settlement.
The figure also depends on the basis chosen. Trade, private sale and retail values differ for the same car, and Form E does not say which to use, so say on the form which one you used. Our guide to trade or private sale value on Form E sets out the choice.
What if the car is on finance or has a poor value?
A car with finance worth more than its value is a liability on the form, not a free gift to whoever keeps it. A car whose value is small may still matter more than its value suggests if it is the only way to get to work. These are the points where the facts of your case do the work, and where a solicitor's advice is worth more than a general guide.
Can a valuation settle it?
A written valuation puts the car, the date and the comparables in one document. It is an independent report for disclosure and negotiation, and we do not act as an expert witness: rule 25.4(2) of the Family Procedure Rules says a person "may not without the permission of the court put expert evidence (in any form) before the court", so ask your solicitor before attaching one to a filing. Frequently asked questions
Who keeps the car in a divorce?
There is no rule. In England and Wales the court has regard to all the circumstances, including the 8 matters in section 25(2) of the Matrimonial Causes Act 1973, and first consideration goes to the welfare of any child under 18. Many couples agree it between themselves with their solicitors.
Does the person who paid for the car keep it?
Not automatically. Section 25 does not say who paid, or whose name is on the V5C, decides it. Form E asks for the total current value of your interest, so how the car was paid for is a point to raise with your solicitor.
Is the car valued at what I paid for it?
No. Form E asks for the total current value of your interest, which is what it is worth now, on a basis you state. What you paid is evidence of its value on the day you bought it.
