Car in a Divorce Settlement: How Its Value Is Offset
Where one person keeps the car in a divorce, the settlement has to account for its value, for example through a larger share of savings, a smaller share of another asset, or a payment. The car is not split in half: it is valued, and the rest of the settlement is balanced around that figure. Because the value moves the balance pound for pound, the figure is worth getting right.
Who keeps the car is one question, and we cover the factors the court weighs in who keeps the car in a divorce. This guide is about the next one: once it is agreed or ordered that one person keeps it, how its value is counted. The worked example uses made-up figures and shows arithmetic only, not what a court would decide in your case.

How is a car counted in a settlement?
Section 24(1)(a) of the Matrimonial Causes Act 1973 lets the court order that one person transfer property to the other. A car can be transferred like any other property. What the person who gives it up receives in return is a matter for the rest of the settlement, which the court sets having regard to the matters in section 25. Source: sections 24 and 25, read on 2 November 2026; they apply to England and Wales.
On Form E, the car sits in section 2.8 at its gross value, as the "Total current value of your interest". Finance on it sits separately in section 2.9, headed "Details of any liabilities you have", which lists hire purchase agreements. The form was read on 2 November 2026.
A worked example with made-up figures
These figures are invented to show the arithmetic. Say a car has a private sale value of £9,000 and £3,000 is still owed on a finance agreement. Person A wants to keep it.
| Item | Figure | Where it goes |
|---|---|---|
| Car, current value | £9,000 | Form E 2.8, gross |
| Finance still owed | £3,000 | Form E 2.9, liability |
| Net to Person A | £6,000 | Car less finance |
If the two agree to treat the car at its net figure, Person A is credited with £6,000 and takes on the finance. Person B then receives £6,000 more from other assets than they would have done had the car gone to B. If the car were valued at £10,000 instead, the net would be £7,000, and £1,000 more would move. A £1,000 difference in the value of the car is a £1,000 difference in the settlement. The court is not bound to use this arithmetic, and a settlement is rarely a simple matter of crediting values, so it shows how the value is used and not what you should expect.

Which value do you use?
The form asks for a current value and does not say which basis. Trade, private sale and retail values differ for the same car, and the gap between them can be larger than the amounts people argue over in the settlement. If the car is being kept, the private sale basis is often the one people reach for. If it is being sold, the figure that matters is what it will actually fetch. Say on the form which basis you used. We set out the choice in trade or private sale value on Form E.
What if the car is worth less than the finance?
Then the net figure is negative, and the person who keeps the car takes on more debt than the car is worth. The example shows how it works the other way round: with a £9,000 car and £11,000 owed, the car is a net liability of £2,000 and that sits against the person keeping it. Whether the other person shares in that is a question for your solicitor. The figure to check first is the settlement figure the finance company gives you, not your monthly statement.
Why a written value helps
A figure each side picks for itself starts an argument. A written valuation sets out the car, the date and the comparable cars behind the number, so the other side can see where it came from. It is an independent report for disclosure and negotiation. We do not act as an expert witness, and rule 25.4(2) of the Family Procedure Rules says a person "may not without the permission of the court put expert evidence (in any form) before the court", so ask your solicitor before attaching one to a filing. Frequently asked questions
How is a car valued in a divorce settlement?
Form E asks for the total current value of your interest in the car, with any finance shown separately as a liability. Which basis to use, such as trade or private sale, is not stated on the form, so say which one you used.
Do you split the value of the car 50/50?
Not automatically. If one person keeps the car, its value is usually set against other assets in the settlement. The court has regard to the matters in section 25 of the Matrimonial Causes Act 1973, not a fixed split.
What happens to car finance in a divorce?
Finance is a liability in section 2.9 of Form E. Whether the person keeping the car takes on the whole agreement, and how that is balanced in the settlement, is a question for your solicitor.
