Buying a Car During Divorce UK: What Form E Asks You to Show

Published 2 November 2026 · 6 min read

Buying a car during a divorce does not stop the financial process, but it changes what you show on Form E. A car you own goes in section 2.8 at its current value, money you spent on it can show up in section 4.1 as a change in your assets, and any finance on it goes in section 2.9. This guide sets out where each piece goes.

Form E is the financial statement each side completes in a financial remedy case in England and Wales. Its opening notes say you have a duty to the court to give full, frank and clear disclosure of your financial and other relevant circumstances. That duty is the reason a car bought mid-divorce is worth getting right on paper.

Where does a car you bought go on Form E?

In section 2.8, "Details of personal belongings individually worth more than £500". The form says to include "Cars (gross value)" and asks for the "Total current value of your interest" in each item. So a car you now own is listed with a brief description and a current figure, and finance is not taken off in that section. Source: Form E (01.23) on GOV.UK, read on 2 November 2026.

The same car can also mean a drop elsewhere. Section 2.7 asks for cash sums held in excess of £500, so money that has gone into the car is no longer shown there. The total of your assets does not rise by the price of the car: one item replaces another.

Where does car finance go?

Section 2.9 is headed "Details of any liabilities you have" and lists hire purchase agreements among the things to include. That is where the outstanding balance on a car bought on finance goes. The notes to the form add that finance payments for a car bought on credit belong in your income needs in section 3.1, and that where a liability is not solely yours you give the other account holder and the amount of your share.

The finance does not change the value of the car, it changes what goes in the liabilities section. Deducting it in both places understates your own position: our guide to car valuation for divorce sets this out.

Do you have to mention a purchase made before you filled in the form?

Section 4.1 asks for "Details of any significant changes in your assets or income", and it asks twice: during the last 12 months (4.1.1) and likely to occur during the next 12 months (4.1.2). The form says to include "The disposal of any asset". Spending savings on a car is a change in your assets, so a purchase of any size that you regard as significant is the kind of thing this section is for. The form does not define "significant", so if you are unsure, put the purchase to your solicitor rather than leave it out.

What if you only plan to buy a car?

Section 3.2 asks for your reasonable future capital needs. The notes to the form say you should include items you hope to buy in the near future and give "the reasonable cost of buying a new car or house" as an example. So a car you want to buy is not hidden, it is a capital need with a cost against it. The word "reasonable" is the form's, and what counts as reasonable for you is a matter for your solicitor and, in the end, the court.

How is the value of a car you just bought set?

Form E does not say how to reach the current value, and the notes do not discuss it. The price you paid is a document and evidence of what the car was worth on the day, but the form asks for the value now. Check the figure against what similar cars are being sold for, and say on what basis you chose it, because trade value, private sale value and retail value can differ for the same car. We explain the choice in trade or private sale value on Form E.

A written valuation puts the comparables and the date in one document. It is an independent report for disclosure and negotiation. We do not act as an expert witness, and rule 25.4(2) of the Family Procedure Rules says a person "may not without the permission of the court put expert evidence (in any form) before the court", so ask your solicitor before attaching one to a filing. Can the court undo a transfer or a purchase?

Section 37 of the Matrimonial Causes Act 1973 deals with transactions intended to prevent or reduce financial relief. Where one person brings proceedings against another, the court may, if satisfied the other party is, "with the intention of defeating the claim for financial relief", about to make a disposition or otherwise deal with property, make an order restraining it. It may also set aside a reviewable disposition made with that intention. The test in the section is intention. Form E itself has a place for this: section 5.3 asks you to identify property if you seek an avoidance of disposition order.

Selling or giving away a car to someone else is the clearer example of a disposition. An ordinary purchase of a car for your own use is a different thing, and whether any step could be challenged in your case is a question for your solicitor, not for a price guide.

What does it mean for the other side?

If you suspect a car has been bought, sold or hidden, the place to start is the other person's Form E: the cars in 2.8, the liabilities in 2.9 and the changes in 4.1. A figure with a source behind it is much easier to compare than a bare number. Because the form is verified by a statement of truth, and the form warns that proceedings for contempt of court may be brought against a person who makes a false statement in a document verified by one, accuracy matters on both sides.

Frequently asked questions

Can I buy a car while going through a divorce?

Nothing in Form E stops you. It asks you to disclose, so the car, any money spent on it and any finance on it have to be shown if they fall within the questions the form asks. Ask your solicitor whether a particular purchase is sensible in your case.

Do I put a car I bought after filing Form E on the form?

Form E is a statement of your finances at the time you sign it, and you have a duty to the court to give full, frank and clear disclosure. If your position changes after that, tell your solicitor so they can advise how and when it is shown to the other side and the court.

Is a new car worth what I paid for it?

The price you paid is evidence of what the car was worth on the day you bought it. Form E asks for the total current value of your interest, so it helps to check the figure against what similar cars are being sold for now.
