Selling a Car Before Divorce Ends: The 3-Year Look-Back
Nothing in the law stops you selling your car while you divorce. What matters is why, to whom and for how much. Section 37 of the Matrimonial Causes Act 1973 lets the court restrain or set aside a disposition made "with the intention of defeating the claim for financial relief", and it presumes that intention for dispositions in the three years before an application if they would have that effect. A sale at a fair price to a genuine buyer is a different thing from a gift or a cheap sale to a friend.
Most car sales during a divorce are ordinary: the car is not needed, the finance is a burden, or the money is. This guide sets out what the Act says, where a sale goes on Form E, and what to keep so that the price is not in doubt. It is general information, not advice on your case: tell your solicitor before you sell.

Can you sell a car while you are divorcing?
Nothing in section 37 bans a sale. The section is about transactions made to defeat a financial claim, and it separates them from ordinary dealings. Under section 37(4) a disposition is "reviewable" unless it was made "for valuable consideration (other than marriage) to a person who, at the time of the disposition, acted in relation to it in good faith and without notice of any intention" to defeat the other person's claim. So a sale for real money to a buyer who knew nothing of the divorce is the kind of dealing the section protects. Source: Matrimonial Causes Act 1973, section 37, read on 2 November 2026. It applies to England and Wales.
What is the three-year rule?
Section 37(5) says that where an application concerns a disposition made less than three years before the date of the application, and the court is satisfied the disposition would have the consequence of defeating the applicant's claim, "it shall be presumed, unless the contrary is shown", that the person acted with that intention. The presumption can be answered. The section leaves it to the person who sold to show the contrary, which is why a record of the price and the reason is worth keeping. The Act also says "disposition" includes "any conveyance, assurance or gift of property of any description", and a sale is a dealing with property.
Selling a car for a fair price rarely defeats a claim, because the money replaces the car and is still there to be counted. A gift, a sale to a relative at a low price, or a sale where the money disappears is where questions come.

Where does a sale go on Form E?
Each person completes Form E. Section 2.8 lists personal belongings individually worth more than £500 and includes "Cars (gross value)", so a car you still own goes there at its current value. Once it is sold, the money is cash and is shown in section 2.7 if you hold more than £500. Section 4.1 asks for "Details of any significant changes in your assets or income" in the last 12 months and the next 12, and the form says to include "The disposal of any asset". A car sale of any size that you regard as significant belongs there, and the form does not define "significant", so ask your solicitor if you are unsure. The form was read on 2 November 2026.
Is a sale during divorce proof that the price was fair?
No. A sale price shows what the buyer paid, not what the car was worth. If a car worth more is sold for less, the gap is exactly what the other side will ask about. Keeping the advert, the messages with the buyer, the bill of sale and the proof of payment shows the sale was real. A dated figure for what similar cars were selling for at the time shows the price was in line with the market.
What if the car is on finance?
If the car is on finance, the agreement has to be dealt with as part of any sale, so ask the finance company what it needs and what the settlement figure is. On Form E, finance is a liability in section 2.9, which lists hire purchase agreements. If you sell, show both the sale and the settlement, so the money left matches the numbers.
How does a valuation help?
A written valuation sets out the car, the date and the comparable cars in one document, so the sale price can be read against a market figure from the time. It is an independent report for disclosure and negotiation. We do not act as an expert witness, and rule 25.4(2) of the Family Procedure Rules says a person "may not without the permission of the court put expert evidence (in any form) before the court", so ask your solicitor before attaching one to a filing. Nothing in a valuation decides whether a sale is challenged. The court's view of a report is covered in is an online car valuation accepted in divorce court.
