Car Valuation for Divorce in Scotland: Which Date?
In a Scottish divorce a car is valued at the "relevant date": whichever is earlier of the day you stopped living together and the day the divorce summons was served. England and Wales have no fixed date, because the court looks at all the circumstances.
That sounds simple, but the date decides which cars are shared and what each is worth. The rule comes from section 10 of the Family Law (Scotland) Act 1985, which does not mention cars, so this guide applies it to a car and says where your solicitor must take over. It is general information, not legal advice.

Which date is a car valued at in a Scottish divorce?
At the relevant date, which section 10(3) defines as the earlier of two dates: the date the two of you ceased to cohabit, and the date the summons in the divorce action was served. The net value of the property is its value at that date, after deducting certain debts still outstanding then (section 10(2)).
An example with made-up dates. You stop living together on 1 March and the summons is served on 20 May: the relevant date is 1 March, so the car is valued as it stood on 1 March. If instead the summons is served on 10 February and you stop living together on 1 March, the relevant date is 10 February.
Which cars count as matrimonial property?
Section 10(4) defines the matrimonial property as property you own at the relevant date that was acquired, other than as a gift or by inheritance from a third party, before the marriage as a family home or its furniture, or during the marriage but before the relevant date. Applied to a car:
Bought during the marriage
A car acquired during the marriage and before the relevant date.
A gift or inheritance
A car that came as a gift or by inheritance from a third party.
Bought before the marriage
Before the marriage only a family home and its furniture count, so on the wording a car does not.
Bought after the relevant date
A car acquired after that date is outside the matrimonial property.
Source: Family Law (Scotland) Act 1985, section 10(4), read on 6 November 2026. The Act says nothing specific about cars, so this is our reading of its wording. Where a car was bought with inherited money, section 10(6)(b) lets the court look at the source of the funds: your solicitor will advise.
What if you start living together again?
Under section 10(7), a period apart is ignored if you went back to living together. The exception is a gap of 90 days or more in a row, followed by fewer than 90 days together in total. In that case the first separation still counts. That is one reason the date is not always obvious: a date you are sure of may not be the date the court uses.
Why the date matters so much for a car
A car loses value as the months pass. By the time of a hearing the same car can be worth much less than on the relevant date, so a figure for today can be the wrong figure. Debts incurred during the marriage that are still outstanding on that date, such as finance on the car, are deducted from the net value.
The hard part comes later. To value a car as it stood on a past date you need its mileage and condition on that day. Most people have to rebuild that from MOT history, service records and old photos, and a gap in the evidence is a gap in the figure.

How is this different from England and Wales?
| Scotland | England and Wales | |
|---|---|---|
| Valuation date | Fixed: the relevant date (section 10(3)) | None set in the section: the court looks at all the circumstances of the case |
| Which property is shared | The matrimonial property, defined by when and how it was acquired (section 10(4)) | The court has regard to the property and other financial resources of each party, among other things |
| How it is shared | Fairly, which is equally unless special circumstances justify another split (section 10(1)) | First consideration to the welfare of any child under 18, then the other factors in the section |

Does a Scottish divorce need a professional car valuation?
Section 10 does not say how a car must be valued. Among the special circumstances it does list the expense of valuing or transferring property in connection with the divorce (section 10(6)(e)), so the cost of a valuation can matter in the split. Your solicitor will tell you what evidence they want.
We value cars as an independent valuer. We do not give legal advice, we do not act as an expert witness, and we cannot say how a court will treat a report. What we can do is set out the comparable cars and the reasoning in one written document.
Frequently asked questions
Is a car bought before the marriage shared in a Scottish divorce?
On the wording of section 10(4), property acquired before the marriage counts only if it was for use as a family home or as furniture for it. A car bought before the marriage is therefore not matrimonial property on that wording. Ask your solicitor how it applies to your case.
What if we start living together again?
A period apart is ignored if you resumed living together, unless you had lived apart for a continuous 90 days or more and then lived together again for less than 90 days in all (section 10(7)).
Does a car I was given by a relative count?
Not if it came to you as a gift or by inheritance from a third party. A gift from your spouse is not from a third party, so that is different. Ask your solicitor about your case.
Do I need a professional valuation of the car in a Scottish divorce?
Section 10 does not say how a car must be valued. It lists the expense of valuing property among the special circumstances (section 10(6)(e)), so the cost can matter in the split. Your solicitor will tell you what evidence they want.
Need a figure for a car of your own?
Send the details and photos. We confirm the cost first, and the written valuation, with the comparables set out, is usually with you the same day.
